EMPLOYMENT AGREEMENT
This agreement made and entered into this _____ day of ______, 20___, by and between _______(“employer”), and ________ (“employee”). The parties recite that :
A. Employer is engaged in ________ and maintains business premises at __________.
B. Employee is willing to be employed by employer, and employer is willing to employ employee, on the terms and conditions hereinafter set forth. For the reasons set forth above, and in consideration of the mutual covenants and promises of the parties hereto, employer and employee covenant and agree as follows :
1. AGREEMENT TO EMPLOY AND BE EMPLOYED
Employer hereby employs employee as ________ at the above-mentioned premises, and employee hereby accepts and agrees to such employment.
2. DESCRIPTION OF EMPLOYEE’S DUTIES
Subject to the supervision and pursuant to the orders, advice, and direction of employer, employee shall perform such duties as are customarily performed by one holding such position in other businesses or enterprises of the same or similar nature as that engaged in by employer. Employee shall additionally render such other and unrelated services and duties as may be assigned to him from time to time by employer.
3. MANNER OF PERFORMANCE OF EMPLOYEE’S DUTIES
Employee shall at all times faithfully, industriously, and to the best of his ability, experience, and talent, perform all duties that may be required of and from him pursuant to the express and implicit terms hereof, to the reasonable satisfaction of employer. Such duties shall be rendered at the abovementioned premises and at such other place or places as employer shall in good faith require or as the interests, needs, business, and opportunities of employer shall require or make advisable.
4. DURATION OF EMPLOYMENT
The term of employment shall be ______ years, commencing on _______, 19___, and terminating _______, 19___, subject, however, to prior termination as otherwise provided herein.
5. COMPENSATION; REIMBURSEMENT
Employer shall pay employee and employee agrees to accept from employer, in full payment, for employee’s services hereunder, compensation at the rate of ________ Dollars ($______) per annum, payable _______. In addition to the foregoing, employer will reimburse employee for any and all necessary, customary, and usual expenses incurred by him while traveling for and on behalf of the employer pursuant to employer’s directions.
6. EMPLOYEE’S LOYALTY TO EMPLOYER’S INTERESTS
Employee shall devote all of his time, attention, knowledge, and skill solely and exclusively to the business and interests of employer, and employer shall be entitled to all benefits, emoluments, profits, or other issues arising from or incident to any and all work, services, and advice of employee. Employee expressly agrees that during the term hereof he will not be interested, directly or indirectly, in any form, fashion, or manner, as partner , officer, director, stockholder, advisor, employee, or in any other form or capacity, in any other business similar to employer’s business or any allied trade, except that nothing herein contained shall be deemed to prevent or limit the right of employee to invest any of his surplus funds in the capital stock or other securities of any corporation whose stock or securities are publicly owned or are regularly traded on any public exchange, nor shall anything herein contained by deemed to prevent employee from investing or limit employee’s right to invest his surplus funds in real estate.
PERJANJIAN KERJA
Perjanjian ini dibuat dan disetujui pada tanggal_____ dan tahun ______, 20___, oleh kedua belah pihak antara_______"perusahaan" (selanjutnya disebut pihak pertama), and ________ “pegawai”(selanjutnya disebut pihak kedua). Kedua belah pihak menyatakan bahwa :
A. Pihak pertama yang bergerak di bidang________ dan beralamat kantor di__________.
B. Pihak kedua bersedia diperkerjakan oleh pihak pertama, dan pihak pertama bersedia memperkerjakan pihak kedua, bedasarkan syarat-syarat dan ketentuan-ketentuan yang ditetapkan bersama. Berdasarkan alasan-alasan yang telah disepakati diatas, dan pertimbangan mengenai kesepakatan-kesepakatan dan perjanjian-perjanjian bersama, dengan ini, pihak pertama dan pihak kedua menyepakati dan menyetujui hal-hal sebagai berikut :
1. PERJANJIAN UNTUK BEKERJA DAN DIPERKERJAKAN
Pihak pertama bersama ini memperkerjakan pihak kedua sebagai________ di kantor yang telah disebtukan diatas, dan pihak kedua bersama ini menerima dan menyetujui pekerjaan tersebut.
2. URAIAN DARI TUGAS-TUGAS PIHAK KEDUA
Tunduk kepada aturan dan patuh terhadap perintah-perintah,anjuran, dan arahan dari pihak pertama, pihak kedua harus melaksanakan tugas-tugas sebagaimana biasanya dilakukan oleh seseorang yang menduduki jabatan serupa dalam rangka usaha-usaha atau perusahaan-perusahaan seperti yang bergerak dibidang yang sama dengan pihak pertama. Pihak kedua juga harus menerima layanan-layanan lainnya yang yang mungkin tidak berkaitan sebagaimana ditugaskan kapan saja kepada pihak kedua oleh pihak pertama.
3. TATA CARA PELAKSANAAN TUGAS-TUGAS PIHAK KEDUA
Pihak kedua selalu setia, tekun, sesuai dengan keterampilan, pengalaman, dan bakat yang dimilikinya, dalam melaksanankan setiap tugas-tugas yang diminta oleh atasan, baik yang tersurat maupun tersirat berdasarkan alasan kepuasan dari pihak pertama.Tugas-tugas tersebut harus diterima di kantor yang beralamat diatas atau ditempat lain yang disebutkan oleh pihak pertama harus dengan itikad baik atau kebutuhan seperti kepentingan, kebutuhan, urusan-urusan, dan kesempatan-kesempatan pihak pertama harus meminta atau membuat anjuran.
4. LAMANYA MASA KERJA
Lamanya masa kerja yang ditentukan adalah selama______ tahun, dimulai dari tahun_______, 19___, dan selesai pada tahun_______, 19___, namun penghentian bisa terjadi sebelum waktu yang ditetapkan dalam perjanjian diatas.
5. PENGGANTIAN;PENEGEMBALIAN
Pihak pertama harus menggaji pihak kedua dan pihak kedua setuju untuk menerima gaji dari pihak pertama, pembagian penuh, berdasarkan jasa-jasa pihak kedua yang tertera pada surat ini, penggantian sebesar________ Dollar ($______) per tahun, yang dapat dibayarkan sebesar_______. Sebagai tambahan , pihak kedua akan membayar kembali pihak pertama terlebih dahulu untuk setiap biaya yang diperlukan dan biasa terjadi pada pihak kedua ketika berpergian berdasarkan kepentingan pihak pertama yang sesuai dengan arahan-arahan pihak pertama.
6. KESETIAAN PIHAK KEDUA KEPADA KEPENTINGAN PIHAK PERTAMA
Pihak kedua harus mencurahkan segala waktu, perhatian, pengetahuan, dan keterampilannya secara khusus hanya untuk urusan-urusan dan kepentingan-kepentingan pihak pertama, dan pihak pertama berhak atas segala manfaat, honor, laba atau hal-hal lain yang ditimbulkan atas setiap pekerjaan, pelayanan, dan saran dari pihak kedua. Pihak kedua terlebih dulu menyetujui bahwa selama syarat didalam, ia tidak akan dipentingkan, baik secara langsung maupun tidak langsung, dalam setiap kondisi, mode, atau cara, baik sebagai rekan, petugas, pengarah, pemegang saham, penasehat, pihak kedua, atau dalam setiap kondisi atau kapasitas lainnya, dalam setiap urusan-urusan yang serupa terhadap urusan-urusan pihak pertama atau setiap perdagangan berserikat, kecuali terhadap ketentuan yang tidak tertera di dalam surat ini harus di akui untuk mencegah atau membatasi hak dari pihak kedua untuk
